POA Decision – 1998/10/13-08 – Work Study/Work Experience in Public Secondary Schools, Section 3(7)(b) of the Workers Compensation Act

The Workers Compensation Act provides compensation coverage for "workers". The Act also allows the Board, by order, to provide coverage to people engaged in work study programs, even though these people do not come within the usual definition of worker. In 1995, at the request of the Minister of Education, the Board extended coverage to secondary students engaged in work study programs who were age 15 or older. This was to accommodate a new educational program which required all secondary students to complete a work study program. In the resolution of October 13, 1998, again at the request of the Minister of Education, the Board extended this coverage to students who are age 14 or older. These students are "deemed" to be workers while engaged in an approved work study program.
