The purpose of this practice directive is to provide guidance to WorkSafeBC officers on the interpretation and application of section 134(3) of the Workers Compensation Act (Act) and policy item C3-14.20 Accident Section 134(3) Presumption, in the Rehabilitation Services & Claims Manual, Volume II (RSCM II). This practice directive describes how the section 134(3) presumption operates and what evidentiary standard is required in order to rebut the presumption.
