When a worker had a casual pattern of employment at the time of their injury, the worker's average earnings determination was based on the worker's gross earnings for the 12 month period immediately preceding the date of injury. The issue of this consultation was how to adequately guide the determination of whether a worker had a casual pattern of employment at the time of their injury.
