WorkSafeBC policy in the Rehabilitation Services and Claims Manual, Volume II provided guidance on determining compensation when a claim was reopened more than three years after the original injury.

At issue was whether policy should be revised to:

• include language that was more reflective of the Workers Compensation Act;
• address more situations that could arise when determining a worker’s compensation; and
• clarify how WorkSafeBC determined whether three years have passed since the original injury occurred.
