Compensation Practice Directive: #C7-1 — Payment of Public Guardian and Trustee, and Committee Fees

Section 231(1)(b) of the Workers Compensation Act provides that WorkSafeBC may redirect compensation payments to another person whom WorkSafeBC considers best to administer the payment when an injured worker is incapable of managing their financial affairs. Persons to whom compensation may be redirected include a private citizen, a trust company, or the Public Guardian and Trustee. There are, however, no direct provisions in the Act regarding whether WorkSafeBC can pay administrative fees to third parties when WorkSafeBC redirects a worker’s benefits.
