BOD Decision - 2020/03/25-03 – Changes to Policy Consequential to Implementing the Revised Workers Compensation Act

Appendix 4 – Certain RS&CM Application Statements

At its March 2020 meeting, WorkSafeBC’s Board of Directors approved consequential revisions to policies in the Rehabilitation Services & Claims Manual, Volume II, the Assessment Manual, and the Prevention Manual, required to reflect the standard statutory revisions made by British Columbia’s Office of the Legislative Counsel to the Workers Compensation Act (“Act”), which will come into effect on April 6, 2020.

The changes reflect editorial changes to the language of the Act, as well as the renumbering of sections, parts, and divisions within the Act. Policies reliant on spent provisions or on provisions that have been rearranged and restructured have also been revised accordingly, but there is no change in the substance of the applicable law or policy.

In the Rehabilitation Services & Claims Manual, Volume II, there is a new policy explaining the legislative change, and the occupational disease policies in Chapter 4 have been revised in the new format of policy publishing; as a result these policies apply to all decisions, including appellate decisions, made on or after April 6, 2020.

The consequential revisions come into effect on April 6, 2020.
