On September 22, 2010, the Supreme Court of British Columbia released a decision in which it determined that the policy regarding the provision of interest on successful reviews or appeals is not a reasonable interpretation of section 259 of the Workers Compensation Act. In light of the Court decision, the Board of Directors of WorkSafeBC approved an amendment to Item AP1-39-2, Assessment Payments, in the Assessment Manual.

The revised policy was effective September 22, 2010.
