Review & Appeal

If you disagree with the decisions we make on claims, assessments, and health and safety enforcement matters, you may have the right to request a review of them and to appeal decisions made from those reviews. Certain decisions may be appealed directly to the Workers’ Compensation Appeal Tribunal (WCAT).

The following levels of review and appeal currently exist:

Review

Reviews are conducted by our internal and impartial Review Division. The Review Division has authority under Part 6 of the Workers Compensation Act to review WorkSafeBC decisions.

Requests for review of compensation and assessment decisions must be submitted within 90 days after the decision. Requests for review of health and safety enforcement decisions must be submitted within 45 days after the decision.

Our objectives are:

  • To provide a simple, flexible process for independently reviewing decisions
  • To help maintain consistency, predictability, and quality in our decision-making
  • To resolve decision disputes in a timely way

Appeal

Appeals are conducted by an external, independent appeals tribunal known as the Workers’ Compensation Appeal Tribunal (WCAT). Most decisions of the Review Division may be appealed to WCAT within 30 days.
