Compensation Practice Directive: #C3-4 — S.5(4) Presumption

The purpose of this practice directive is to provide guidance to WorkSafeBC officers on the interpretation and application of section 5 (4) of the Workers Compensation Act (the “Act”) and policy item C3-14.20 Accident Section 5(4) Presumption, in the Rehabilitation Services & Claims Manual, Volume II (“RSCM II”). This practice directive describes how the section 5(4) presumption operates and what evidentiary standard is required in order to rebut the presumption.
