THE WORKERS' COMPENSATION BOARD OF BRITISH COLUMBIA

RESOLUTION OF THE PANEL OF ADMINISTRATORS

Re: Repeal of Sections 8, 9 and 9.1 of the Fishing Industry Regulations


WHEREAS:

Pursuant to Section 82 of the Workers Compensation Act ("Act"), RSBC 1996, Chapter 492 and amendments thereto, the Panel of Administrators ("Panel") must approve and superintend the policies and direction of the Workers’ Compensation Board ("Board"), including policies respecting compensation, assessment, rehabilitation and occupational health and safety, and must review and approve the operating policies of the Board;

AND WHEREAS:

Section 4 of the Act authorizes the Lieutenant Governor in Council to make regulations for a number of matters relating to the fishing industry;

AND WHEREAS:

The Fishing Industry Regulations (B.C. Reg. 674/76) ("Regulations") have been made pursuant to Section 4;

AND WHEREAS:

Section 15 of the Regulations authorizes the Board to add to and amend the Regulations and exercise all the powers conferred by section 4 of Part 1 of the Act;

AND WHEREAS:

Sections 8, 9 and 9.1 of the Regulations address occupational health and safety matters, and such matters are now dealt with by Part 3 of the Act and the provisions of the occupational health and safety regulations; 

THE PANEL OF ADMINISTRATORS RESOLVES THAT:

  1. Pursuant to Section 15 of the Fishing Industry Regulations (B.C. Reg. 674/76), Sections 8, 9 and 9.1 of the Regulations are repealed;
  2. The document attached to this resolution will be deposited with the Registrar of Regulations in such form as may be required by the Registrar; and
  3. Pursuant to Section 76 of the Act, the repeal of Sections 8, 9 and 9.1 of the Regulations will be effective 90 days after the document attached to this resolution is deposited under the Regulations Act.

  2. Section 1 comes into force 90 days after this resolution is deposited under the Regulations Act.
