Re: Multiple Classification Policy
Pursuant to Section 82 of the Workers Compensation Act, RSBC 1996, Chapter 492 and amendments thereto ("Act"), the Panel of Administrators ("Panel") must approve and superintend the policies and direction of the Workers' Compensation Board ("Board") including policies respecting compensation, assessment, rehabilitation and occupational safety and health and must:82(a)(ii) review and approve operating policies of the Board,
82(a)(iv) develop polices to ensure adequate funding of the accident fund,
82(a)(vi) plan for the future of the Board;
The Board has authority under Section 37(2) of the Act to create and rearrange classes, and to assign employers, independent operators, or industries to one or more classes;
Under Section 42 of the Act the Board must establish sub-classifications, differentials and proportions in the rates as between the different kinds of employment in the same class as may be considered just;
The Panel approved a new classification system for employers and independent operators, effective January 2000;
It is necessary to amend the Assessment Policy Manual to ensure that the multiple classification policy is consistent with the new classification system;
On July 17, 2001, the Panel gave approval-in-principle to the general strategy for revising the multiple classification policy.
