THE WORKERS' COMPENSATION BOARD OF BRITISH COLUMBIA

RESOLUTION OF THE PANEL OF ADMINISTRATORS

Re: Consolidation of Fishing Operations Policies in the Prevention Manual



WHEREAS:

Pursuant to Section 82 of the Workers Compensation Act ("Act"), RSBC 1996, Chapter 492 and amendments thereto, the Panel of Administrators ("Panel") must approve and superintend the policies and direction of the Workers’ Compensation Board ("Board"), including policies respecting compensation, assessment, rehabilitation and occupational safety and health, and must review and approve the operating policies of the Board;

AND WHEREAS:

The policies respecting occupational safety and health ("prevention policies") are found in a variety of sources, including the Prevention Division Policy and Procedure Manual and the Prevention Manual;

AND WHEREAS:

In response to direction from the Panel of Administrators, the Policy and Regulation Development Bureau has initiated an "editorial" consolidation project to review all prevention policies not found in the Prevention Manual, and bring forward recommendations to the Panel for consolidation in the Prevention Manual and/or repealing or retiring as appropriate;

AND WHEREAS:

The Bureau has presented recommendations to the Panel with respect to consolidating Fishing Operations policies from the Prevention Division Policy and Procedure Manual into the Prevention Manual;

THE PANEL OF ADMINISTRATORS RESOLVES THAT:

  1. The statements under the heading POLICY in each Item attached as Appendix "A" are approved and the Items will be consolidated into the Prevention Manual.
  2. The policies listed in Appendix "B" are "retired" from the Prevention Division Policy and Procedure Manual as of the effective date of this resolution ("retirement date"). As of the "retirement date", they are no longer "policy" or "published policy of the governors" under Bylaw No. 4 (10 WCR 781). However, their status as "policy" or "published policy" prior to the "retirement date" remains unaffected by this resolution. They remain applicable in decision-making on historical issues to the extent they were applicable prior to the "retirement date".
  3. This resolution constitutes a policy decision of the Panel of Administrators.
  4. This resolution is effective July 1, 2000.
