RESOLUTION OF THE PANEL OF ADMINISTRATORS

Re: Strategy for retiring Workers' Compensation Reporte

Decisions No. 1 -- 423 Over Time



WHEREAS:

Pursuant to Section 82 of the Workers Compensation Act ("Act"), RSBC 1996, Chapter 492 and amendments thereto, the Panel of Administrators ("Panel") must approve and superintend the policies and direction of the Workers' Compensation Board ("Board"), including policies respecting compensation, assessment, rehabilitation and occupational safety and health, and must review and approve the operating policies of the Board:

AND WHEREAS:

The Panel has been appointed to discharge the powers, duties and functions of the former Governors under the legislation administered by the Workers' Compensation Board;

AND WHEREAS:

Section 82(a)(vii) of the Act requires the Governors to enact bylaws and pass resolutions for the conduct of the business and functions of the Governors including bylaws with respect to the manner in which their policies are to be published;

AND WHEREAS:

Pursuant to Governors' Bylaw No. 4 (10 WCR 781), and subsequent Panel decisions, "published policy of the governors" includes the Assessment Policy Manual, the Prevention Division's Policy and Procedure Manual, the policy statements in the new Prevention Manual, the Rehabilitation Services and Claims Manual and Workers' Compensation Reporter Decisions No. 1 — 423;

AND WHEREAS:

Workers' Compensation Reporter Decisions No. 1 — 423 ("Old Reporter Decisions") set out the decisions of the pre-1991 Commissioners from 1973 to 1991 on appeals, questions of general policy and other matters;

AND WHEREAS:

Having multiple sources of "published policy" for each area of the Board's responsibilities is potentially confusing for employers, workers and other workplace parties, and for Board staff;

AND WHEREAS:

The Panel considers that "published policy" in each area of the Board's responsibilities should generally appear in only one source — one Policy Manual for that area;

AND WHEREAS:

The Policy and Regulation Development Bureau has presented a general strategy to the Panel for consolidating the Old Reporter Decisions with the various policy manuals and/or "retiring" them over time:

THE PANEL OF ADMINISTRATORS RESOLVES THAT:

1. The Panel approves in principle the general strategy of consolidating Decisions No. 1 — 423 of the "old" Workers' Compensation Reporter with the policy manuals and/or "retiring" them over time.

2. A "retired" Decision is, as of the "retirement" date, no longer "policy" or "published policy of the governors" under Bylaw No. 4 (10 WCR) 781. "Retiring" does not affect a Decision's status as "policy" or "published policy" prior to the "retirement" date. A "retired" Decision therefore remains applicable in decision-making on historical issues. "Retiring" also does not affect the disposition of any individual matters dealt with in the "retired" Decision.

3. The Old Reporter Decisions set out in Appendix "A" are "retired" effective May 1, 2000.

    4. For greater clarity:

    1. "Historical Consumer Price Index adjustments and other cost of living adjustment Decisions" (category (a) in Appendix "A") will continue to apply to decision-making on historical issues insofar as they were applicable immediately prior to the retirement date.
    2. "Historical statutory maximum wage rate adjustments" (category (b) in Appendix "A") will continue to apply to decision-making on historical issues insofar as they were applicable immediately prior to the retirement date.
    3. Retiring "Decisions that restate amendments to the Workers Compensation Act" (category (c) in Appendix "A") does not affect the operation or effect of the provisions that were restated.
    4. Retiring "Decisions that have been expressly replaced or superseded by other Decisions or repealed by the Panel of Administrators" (category (e) in Appendix "A") does not imply that these Decisions were revived in some way subsequent to being replaced, superseded or repealed.
    5. "Miscellaneous Decisions that, for various reasons, are no longer current" (category (g) in Appendix "A") will continue to apply to decision-making on historical issues insofar as they were applicable immediately prior to the retirement date.

5. When bringing forward policy issues to the Panel for decision, the Policy and Regulation Development Bureau will include as part of its recommendations the consolidation and/or "retiring" of any Old Reporter Decision relevant to the particular issue.

6. The Director General of the Policy and Regulation Development Bureau will create Appendices for the Assessment Policy Manual, the Prevention Manual and the Rehabilitation Services and Claims Manual that will list the retired Old Reporter Decisions, with the retirement date for each Decision, and provide a suitable explanation as to the meaning of "retired". Updating each Appendix as the Panel makes decisions to consolidate and/or "retire" Old Reporter Decisions will form part of the Director General's housekeeping authority under Resolution 98/12/18-03, Housekeeping Changes to Policy Documents.

7. This resolution constitutes a policy decision of the Panel of Administrators and amends Governors' Bylaw No. 4 (10 WCR 781) to the extent necessary to give it effect.

8. This resolution is effective May 1, 2000.

Section 52 - "Special Circumstances"

Review of Board of Review Decision: An application must be filed within one year after the date of injury in order to be eligible for compensation. The one-year period commences at the time of injury, not at the time of a subsequent disablement or when medical aid is sought. Special circumstances may include minor injuries where the worker did not need to seek medical treatment and where the employer is not required to report the minor injury to the Board. The Board's decision to accept an application for compensation beyond the one year period will depend a great deal on the time lapse since the injury is alleged to have occurred because the lapse will affect the Board's ability to investigate the injury and its relationship to the subsequent condition. There must be clear and unequivocal evidence pointing to a relationship to the latter medical difficulties and the original injury.
