RESOLUTION OF THE PANEL OF ADMINISTRATORS

Re: Work Study/Work Experience in Public Secondary
Schools, Section 3(7)(b) of the Workers Compensation Act



WHEREAS:

Pursuant to Section 82 of the Workers Compensation Act, RSBC 1996, Chapter 492 and amendments thereto (the "Act"), the Panel of Administrators (the "Panel") must approve and superintend the policies and direction of the Workers' Compensation Board (the "Board"), including policies respecting compensation, assessment, rehabilitation and occupational safety and health;

AND WHEREAS:

Coverage of students in the public secondary schools engaged in the Ministry of Education Work Study/Work Experience Program (the "Program") is provided under Section 3(7)(b) of the Act;

AND WHEREAS:

Coverage for the Program in the public secondary schools is paid for by the Provincial Government on a self-insured basis as provided for under Section 3(7)(b). The Ministry of Education, not the Board, has set eligibility criteria for participants in the Program. Their criteria limited coverage to students who were 15 years of age or older or 14 years of age and enrolled in a career and personal planning program. This criteria was included with the Panel's August 3, 1995 Resolution. The Ministry of Education, Skills and Training included the Board Minute in their Order-In-Council 1252/95.

AND WHEREAS:

The Ministry of Education requests the minimum age change, which they have made in their criteria, be reflected by a Panel Resolution so that they may proceed to amend their Order-In-Council.

AND WHEREAS:

In discussions with the Ministry, the Assessment Department has advised that any change to minimum age does not obviate their responsibility with respect to safety issues.

THE PANEL OF ADMINISTRATORS RESOLVES THAT:

The Resolution of the Panel of Administrators dated August 3, 1995, re Ministry of Education -- Work Study/Work Experience Programs is amended by limiting coverage to students who are 14 years of age or older.
