REVISED RESOLUTION OF THE PANEL OF ADMINISTRATORS

September 11, 1998

Re: Hand-Arm Vibration Syndrome (HAVS)



WHEREAS:

Pursuant to Section 82 of the Workers Compensation Act, RSBC 1996, Chapter 492 and amendments thereto (the "Act"), the Panel of Administrators (the "Panel") must approve and superintend the policies and direction of the Workers' Compensation Board (the "Board"), including policies respecting compensation, assessment, rehabilitation and occupational safety and health, and must review and approve the operating policies of the Board;

AND WHEREAS:

The Board's current policy for assessing pensions for HAVS is provided in Policy Item #39.44 of the Rehabilitation Services and Claims Manual.

AND WHEREAS:

Various parties, including members of the worker community, the Appeal Division and specialists in the medical community have expressed concern about the use of the Laroche table, upon which Board policy is based.

THE PANEL OF ADMINISTRATORS RESOLVES THAT:

  1. Policy Item #39.44 in the Rehabilitation Services and Claims Manual is amended as shown in Appendix I. The policy applies to new claims received and all active claims that are currently awaiting an initial pension adjudication.

  2. Policy Item #27.13 in the Rehabilitation Services and Claims Manual is amended as shown in Appendix II.

  3. The amended policies are effective September 11, 1998.
