Re: Authority of Case Managers
Pursuant to Section 82 of the Workers Compensation Act, RSBC 1996, Chapter 492 and amendments thereto (the "Act"), the Panel of Administrators (the "Panel") must approve and superintend the policies and direction of the Workers' Compensation Board (the "Board") including policies respecting compensation, assessment, rehabilitation and occupational safety and health;
The Board's Strategic Plan contemplates the development of a "case management" approach to handling workers' claims whereby accountability for each complex case would be assigned to one Case Manager;
The Administration has been conducting a case management pilot project in Prince George and North Vancouver;
On November 14, 1997, Case Managers involved in the pilot project were authorized by the Panel of Administrators to perform the functions and make the decisions assigned to various Board Officers by the Rehabilitation Services and Claims Manual;
Effective February 27, 1998, an agreement was reached between the Board and the Compensation Employees' Union to reclassify all Claims Adjudicator positions at the Board to Case Manager positions;
Claims Adjudicators reclassified as Case Managers, newly hired Case Managers and Case Managers within the pilot project have been performing the functions and making the decisions assigned by the Rehabilitation Services and Claims Manual to Claims Adjudicators since that date;
A policy decision is required by the Panel to authorize all Case Managers, not just Case Managers within the pilot project, to perform the functions and make the decisions assigned by the Manual to Claims Adjudicators;
