WHEREAS, effective December 31, 2003, sections 25 and 25.2 of the Workers Compensation Act ("Act") will require the Board to determine as of January 1, 2004, a percentage change by comparing the Consumer Price Index for October 2003 with the Consumer Price Index for October 2002 and by applying that percentage change to adjust those periodic payments of compensation referred to in section 25(3), and to adjust dollar amounts in the Act referred to in section 25.2(1);
AND WHEREAS the Board is required to make this determination prior to amendments to sections 25 and 25.2 coming into force in order that the Board is able to make the required adjustments as of January 1, 2004;
AND WHEREAS the Board is advised that the Consumer Price Index for October 2002 was 120.5 and for October 2003 was 122.4, giving a percentage change of 1.576763 percent, and subtracting 1% gives a percentage change of 0.576763 percent;
AND WHEREAS B.C. Reg. 36/2003 and 310/2003 amended dollar amounts described in section 25.2(1) as of January 30, 2003 and July 25, 2003 as shown in column 1 below;
THE BOARD HEREBY DETERMINES THAT B.C. Reg. 325/2002 and 216/2003 shall be repealed as of January 1, 2004;
AND THAT the percentage change applicable under section 25(1)(b) is 0.576763 percent;
AND THAT all periodic payments of compensation described in section 25(3) shall be adjusted by applying the percentage change of 0.576763 as of January 1, 2004;
AND THAT the percentage change applicable under section 25.2(1) is 1.576763 percent;
AND THAT all dollar amounts referred to in section 25.2(1) of the Act,
shall be adjusted by applying the percentage change of 1.576763 as of
January 1, 2004, as follows:

Section 25.2 of the Workers Compensation Act ("Act") requires some dollar figures in the Act to be adjusted by the Board annually according to changes in the Consumer Price Index.
Apart from the figures in the Act, the policies of the Board contain various dollar allowances or amounts. With regard to funeral and other death expenses, the Board of Directors have resolved to make Consumer Price Index adjustments to the amounts on January 1 of each year (Item C8-54.00 of the Rehabilitation Services and Claims Manual, Volume II).
As a result, the rates set out below are effective January 1, 2004.
