Proposed Amendments to Policy on Average Earnings and Worker Expenses

Earnings for some workers include payment not only for labour, but also for supplies, equipment or other costs. When a worker in this situation is injured, WorkSafeBC must base the worker's compensation on only the labour portion of his or her contract(s). WorkSafeBC must deduct operating costs and expenses from such a worker's gross earnings to determine the worker's average earnings for the purposes of determining compensation.

At issue is how to determine the types of operating costs and expenses that should be deducted from gross earnings in order to calculate a worker's average earnings.

At their meeting on March 21, 2006, the Board of Directors approved the release of a discussion paper with options and draft policy amendments for stakeholder consultation. Proposed deletions of policy wording are identified with a strikethrough and additions are identified in bold.

The consultation period will end on May 12, 2006. The Board of Directors will consider stakeholder feedback before making a decision on policy amendments.
