The Skills Development and Labour Statutes Amendment Act, 2003 ("Bill 37") will change how compensation for the surviving dependants of a deceased worker is calculated. Most of these changes will be retroactive to June 30, 2002.
Bill 37 will also amend the provision in the Workers Compensation Act dealing with mental stress and introduce a new provision relating to non-lawyers who act as advocates within the workers' compensation system.
In order to implement these changes, the Workers' Compensation Board ("WCB") must bring its policies into line with the new legislative provisions. As a result, the WCB's Policy and Regulation Development Bureau ("Bureau") has developed the attached policy framework (PDF 56kb), which will guide the development of policy in response to Bill 37.
Stakeholders are invited to provide their comments on the policy framework to the Bureau by October 31, 2003.
