Under the British Columbia Freedom of Information and Protection of Privacy Act (FIPPA), injured workers can request copies of their claim file, including all clinical reports related to assessment and treatment.
As a clinical professional you are expected to give feedback on treating an injured worker in your reports. Not only is this highly recommended, it is ethically appropriate. Your feedback should deal specifically with clinical issues and not with claims or compensation issues.
Limitations to disclosure
WorkSafeBC psychologists work closely with the FIPPA coordinators to recognize
and address psychological ethics and legal standards. If a worker requests
disclosure of his or her file, we need to determine whether such disclosure
could reasonably be considered harmful to the worker or others, as there
are some exclusions allowable under the FIPPA legislation.
