The Medical Review Panel is an independent review body and the last avenue of appeal regarding a Board Officer or Appeal Division decision, or Review Board finding on medical matters.
A worker or the worker's employer may request an examination by a Medical Review Panel. The appellant must file an application within 90 days of the medical decision or finding in dispute.
Each Medical Review Panel consists of three independent community-based physicians: one physician is a government-appointed chair, and the other two are specialists in the particular class of injury or disease for which the worker is claiming compensation. From the list of specialists, the worker or dependant and the employer each choose a specialist to serve on the Medical Review Panel.
The Medical Review Panel will examine the worker and the medical records of the worker whose case is under appeal. The medical decisions of a Medical Review Panel are conclusive and binding on the Board and all parties to the dispute.
The provincial government recently proclaimed Bill 63, Amendments to the the Workers Compensation Act (PDF 130kb). Bill 63 establishes changes to the appeal process, and the Medical Review Panel. Read more about these changes.
